Digital Signature Service Terms

By using the wiwink digital signature service, the customer and the signatories accept the conditions set out in this document. We recommend reading it before sending your first document for signature.

wiwink is a provider of non-qualified electronic trust services, registered with the Ministry for Digital Transformation and Civil Service under Law 6/2020 and the eIDAS Regulation (EU) No 910/2014.

2. Description of the service

The wiwink digital signature service allows you to:

  • Send PDF documents to be signed by one or more people (signatories).
  • Obtain a simple or advanced biometric electronic signature on the document.
  • Generate a signed document with full legal validity in Spain and the European Union.
  • Keep the signed document and its audit evidence.
  • Verify the authenticity and integrity of the signed document at any time.

3. Types of signature available

3.1 Simple signature (one click)

The simple signature is a basic electronic signature within the meaning of Article 3.10 of the eIDAS Regulation. The signatory accepts the document by clicking the sign button after identifying themselves through the personalised link received by email or SMS. The resulting document is sealed with wiwink's Qualified Electronic Seal Certificate and the FNMT-RCM timestamp.

3.2 Advanced biometric signature

The advanced biometric signature is an advanced electronic signature within the meaning of Article 3.11 of the eIDAS Regulation. The signatory draws a handwritten stroke on the screen, which is cryptographically linked to the document. In addition to the wiwink seal and the timestamp, the document includes the biometric data of the stroke (pressure, speed, acceleration), which makes it possible to verify the signatory's identity by forensic means if necessary.

4. Legal validity

Documents signed through wiwink are legally valid in Spain and throughout the European Union, in accordance with:

  • Regulation (EU) No 910/2014 (eIDAS), as amended by Regulation (EU) 2024/1183.
  • Law 6/2020 of 11 November, regulating electronic trust services.
  • Law 34/2002 on information society services and electronic commerce.

The wiwink simple signature has legal effect as an electronic signature within the meaning of Article 25.1 of the eIDAS Regulation: it cannot be denied legal effect or admissibility as evidence in legal proceedings solely on the grounds that it is in electronic form.

For contracts and documents that legally require a qualified electronic signature (QES), wiwink recommends consulting your legal adviser.

5. Customer obligations

The customer (the company or person who subscribes to the service and sends documents for signature) undertakes to:

  • Use the service only for documents whose content is lawful and for which they are entitled to request a signature.
  • Obtain the signatories' informed consent before sending them documents, in compliance with the General Data Protection Regulation (GDPR).
  • Not use the service to send documents with fraudulent or deceptive content, or content that misleads the signatory.
  • Keep the signed documents downloaded from the platform for the period applicable to the nature of each contract or document.
  • Report to wiwink any misuse of the service or security incident they detect.

6. wiwink obligations

wiwink undertakes to:

  • Provide the service with due diligence and in accordance with the applicable technical and legal standards.
  • Keep the signed documents and their audit evidence for the duration of the service contract and, for the audit evidence, for at least 5 additional years.
  • Notify customers of any security incident that may affect their documents.
  • Keep the Qualified Electronic Seal Certificate and the FNMT-RCM time-stamping service (TSA) valid throughout the provision of the service.
  • Comply with data protection regulations (GDPR) when processing the signatories' personal data.

7. Responsibility of the parties

7.1 Limitation of wiwink's liability

wiwink will not be liable for:

  • The content of the documents sent for signature by the customer.
  • The use the customer makes of the signed documents or the audit evidence.
  • Damage arising from incorrect use of the service by the customer or the signatories.
  • Occasional service interruptions due to causes beyond wiwink's control (planned AWS maintenance, FNMT-RCM incidents, etc.).

7.2 Customer responsibility

The customer assumes full responsibility for:

  • The accuracy and identity of the signatories to whom they send documents.
  • The lawfulness of the content of the documents that use the service.
  • The long-term custody of the signed documents downloaded from the platform.

8. Data protection

In the signing process, wiwink acts as data processor for the signatories' personal data (name, email, phone, IP, biometric data in advanced signatures) on behalf of the customer, who acts as data controller.

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD). For more information, see our Privacy Policy at https://wiwink.com/privacidad.

9. Fees and financial terms

The service fees are published at https://wiwink.com/efirma-firma-digital and are invoiced according to the plan subscribed. wiwink reserves the right to update its fees, giving at least 30 days' notice.

10. Changes to the terms

wiwink may amend these terms at any time, notifying registered customers of the changes at least 15 days in advance. Continued use of the service after notification implies acceptance of the new terms.

11. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute arising from the provision of the service, the parties submit to the Courts and Tribunals of Madrid, unless consumer protection legislation establishes a different jurisdiction.
